Actor sequitur forum rei = Plaintiff (actor) must follow (sequitor) the court (forum) of the defendant (rei/reus) Comitas (gentium) = Between courtesy or legal duty. Vested rights of parties should be respected in foreign courts.; states apply foreign law out of comity. Exceptio litis pendentis = An exception (formal argument) taken by one of the parties in litigation that litigation between the same parties on the same cause of action is already pending in another court. Exequatur = Declaration of enforceability of a foreign judgment. Favor divortii = Law should allow for the concept of divorce if the parties wish so. Forum actoris = The forum in which the claimant or plaintiff resides or has domicile. Forum (non) conveniens = The court is sometimes allowed to exercise jurisdiction if the case is more closely connected to its own legal order. The court that would have jurisdiction under PIL may decline jurisdiction if another court seems to be the more appropriate choice (more common law concept, except e.g. art 15 Brussel II). Forum necessitatis = The forum with the closest connection may claim jurisdiction in a case where no other court is competent. Forum prorogatum = Forum which is agreed upon by the parties. Forum rei = Forum of the defendant (where he is domiciled) has jurisdiction. Forum solutionis = Court of the country of relevant performance Forum loci delicti = Court of the place where the tort/harmful event occurred. Forum rei sitae = The court where the thing/good is situated (esp. for immovables). Fraus legis = Circumvention of the proper applicable law (art. 18 Belgian PIL Act) Ius sanguinis = Right to determine nationality according to the nationality of one/both parents (right of blood). Ius soli = Known as the birthright citizenship, meaning a right by which nationality can be recognised to any individual born in the territory of the related state Lex causae = The law or laws chosen by the forum court to arrive at its judgement in a case with international implication. Lex domicilii (communis) = The law of the country of common domicile. Lex fori = The law of the country of the court seised. Lex loci celebrationis/ lex loci contractus celebrati = The law of the place of marriage. Lex loci actus = Law of the place where the act occurred that gave rise to the legal claim. Lex loci contractus = Law of the place where the contract was concluded. Lex loci delicti (commissi) = The place of the place where the wrongdoing was comitted. Lex loci destinationis = Law of the country of the destination of the goods. Lex loci expeditionis = The law of the place from where the good were dispatched. Lex patriae (communis) = Law of the common nationality. Lex personalis = The personal law may be determined either by the law of the party's place of domicile (lex domicilii) or by his national law (lex ligeantiae). Lex rei sitae = Law of the place where the objects/assets are located. Lex situs = Law of the place where the objects/assets are located. Lis pendens = Proceedings involving the same issue and between the same parties is pending in different courts. Locus regit actum = The law of the place where the facts occurred. Locus sine lege = Place without law (international territory). Perpetuatio fori/Perpetuatio iruisdictionis = Jurisdiction (once determined) stays with the court even though the circumstances may change. Res in transit = Goods in transport. Statuta realia = Statutes for immovables (land), governed territoriality. Statuta personalia = Statutes about persons, follow the person involved. Statuta mixta = All other statutes, introduced as a 3rd category. Lex furti = The law of the country where the theft was committed
